TERMS OF SERVICE

These Terms of Service govern the use of the Mrs. Red Art website (the “Site”) and provide information relevant to enquiries and any purchases that may subsequently be agreed.
The Site is operated under the name Mrs. Red Art and is powered by Shopify.
The Site currently operates on an enquiry-only basis. Orders, payments and purchases cannot be completed directly through the Site.
The Site does not display public purchase prices. Price information and the relevant purchase terms are provided individually following an enquiry.
1. PURPOSE OF THE SITE
The Site presents original artworks, Fine Art Prints, bespoke portrait commission information and related artistic content.
Visitors may view the works and, where applicable, submit an enquiry concerning availability, a possible purchase or a bespoke commission.
Submitting an enquiry does not create an obligation to purchase or pay.
2. ENQUIRIES, QUOTATIONS AND CONTRACT FORMATION
Submitting an enquiry through the Site or by email does not constitute an order, acceptance of an offer or a binding purchase agreement.
Following an enquiry, Mrs. Red Art may provide information including a price quotation, artwork details, shipping arrangements, payment terms and other relevant purchase conditions.
Unless expressly stated otherwise in writing, a price quotation, price list or other information supplied following an enquiry does not by itself constitute a binding offer or reserve an artwork.
Before any purchase is finalised, the prospective purchaser will be provided with the material terms applicable to the proposed purchase, including, where relevant:
- the identity and main characteristics of the artwork or product;
- availability;
- the total price;
- applicable taxes or charges payable to Mrs. Red Art;
- shipping costs and arrangements;
- estimated delivery timeframe;
- payment arrangements;
- information concerning withdrawal, returns and refunds; and
- any specific terms applicable to a bespoke commission.
A binding purchase agreement is formed only when the relevant terms have been agreed and Mrs. Red Art expressly confirms the purchase in writing.
Confirmation will normally be provided by email or another appropriate durable medium.
No payment obligation arises merely from submitting an enquiry or requesting price information.
3. PRODUCT AND ARTWORK INFORMATION
Mrs. Red Art makes reasonable efforts to ensure that descriptions, dimensions, materials, edition information and other information concerning original artworks and Fine Art Prints are accurate.
Images displayed on digital screens may differ slightly from the physical artwork because of photography, lighting, screen calibration and display settings.
Original artworks are unique works.
Fine Art Prints are offered as limited editions only where this is expressly stated in the relevant artwork information or in the information supplied before purchase.
4. AVAILABILITY AND RESERVATION
Original artworks are unique and their availability may change.
Submitting an enquiry does not by itself reserve an artwork or Fine Art Print.
An artwork or product is reserved only where this has been expressly confirmed by Mrs. Red Art.
Until a reservation or purchase has been expressly confirmed, Mrs. Red Art may respond to enquiries from other prospective purchasers concerning the same work.
5. PRICES, CURRENCY, TAXES AND ADDITIONAL COSTS
Purchase prices are not publicly displayed on the Site.
Price information is provided individually following an enquiry.
The prospective purchaser will be informed of the applicable price and material additional costs before a purchase is finalised.
Price information may be provided in EUR or another appropriate currency. Where applicable mandatory law requires price information to be provided in a particular currency, form or manner, the required information will be provided before the purchaser becomes bound by a contract.
Shipping costs may be quoted separately because they depend on factors including destination, dimensions, value, packaging requirements and carrier arrangements.
Where customs duties, import taxes or other destination-country charges cannot reasonably be determined or collected by Mrs. Red Art in advance, the purchaser will be informed before the purchase is finalised that additional charges may apply.
No additional charge payable to Mrs. Red Art will be imposed without the purchaser being informed of it in advance where such prior information is required by applicable law.
Nothing in these Terms limits mandatory pricing or pre-contractual information requirements under applicable law.
6. PAYMENT
Payments cannot be made directly through the Site.
The available payment method, currency, payment deadline and any other relevant payment conditions will be communicated and agreed before the purchase is finalised.
The purchaser should make payment only in accordance with the payment instructions provided directly by Mrs. Red Art in connection with the agreed purchase.
7. SHIPPING
Mrs. Red Art offers shipping within Hungary and internationally to destinations where delivery is available and lawful.
International shipping is subject to carrier availability, destination restrictions, customs requirements and applicable laws.
Shipping to every country or territory cannot be guaranteed.
The availability, method, cost and estimated timeframe of shipping will be communicated before a purchase is finalised.
Shipping is governed by the Shipping Policy published on the Site.
Because the Site operates on an enquiry-only basis, shipping costs are not calculated or charged through an online checkout.
8. DELIVERY
The applicable estimated delivery timeframe will be communicated before the purchase is finalised.
Delivery may be affected by destination, carrier operations, customs procedures or other circumstances outside the reasonable control of Mrs. Red Art.
Nothing in these Terms limits mandatory delivery deadlines, transport-risk rules or other rights available under applicable consumer protection law.
9. RETURNS, WITHDRAWAL AND REFUNDS
Withdrawal, return and refund rights are described in the Return and Refund Policy published on the Site.
Nothing in these Terms excludes or limits any mandatory right available to a consumer under applicable law.
Where a statutory right of withdrawal applies, the purchaser will receive the information required by applicable law before becoming bound by the purchase.
10. BESPOKE PORTRAIT COMMISSIONS
Bespoke portrait commissions are created individually according to requirements agreed with the purchaser.
Before a commission is finalised, the relevant details, including the subject, size, price, payment arrangements, expected timeframe and other material requirements, will be agreed in writing.
Where the applicable legal requirements are met, statutory withdrawal rights may not apply to goods made to the purchaser’s specifications or goods that are clearly personalised.
The purchaser will be informed of the applicable terms and any relevant withdrawal exception before the bespoke commission is finalised.
11. STATUTORY CONSUMER RIGHTS
Nothing in these Terms limits or excludes statutory rights relating to damaged, defective, incorrect or otherwise non-conforming goods.
Mandatory rights relating to conformity, remedies and other consumer protections apply in accordance with applicable law.
Unless expressly agreed otherwise in writing, Mrs. Red Art does not provide a separate voluntary commercial guarantee in addition to rights required by law.
This does not affect any mandatory statutory rights of the purchaser.
12. INTELLECTUAL PROPERTY AND COPYRIGHT
Copyright and other intellectual property rights in original artworks and other original creative content remain with their respective rights holder unless expressly transferred in writing.
Purchase and physical ownership of an original artwork or Fine Art Print do not by themselves transfer copyright or other intellectual property rights in the work.
Images of artworks, photographs, text, designs, branding and other Site content owned by Mrs. Red Art or used with permission are protected by applicable intellectual property laws.
Except where permitted by applicable law or expressly authorised in writing, no permission is granted to reproduce, copy, publish, distribute, commercially exploit, modify or create derivative works from Mrs. Red Art artworks or protected Site content.
The name Mrs. Red Art and associated branding may not be used in a manner that falsely suggests endorsement, affiliation or authorisation.
13. ACCEPTABLE USE OF THE SITE
The Site must not be used for unlawful or fraudulent purposes.
Users must not interfere with the operation or security of the Site, introduce malicious code, attempt unauthorised access to the Site or related systems, or unlawfully copy, scrape, reproduce or commercially exploit protected Site content.
Mrs. Red Art may take reasonable measures to protect the Site, its content and intellectual property against misuse.
14. THIRD-PARTY SERVICES AND LINKS
The Site is powered by Shopify and may contain links to independent third-party websites or services, including social media platforms.
Third-party websites and services operate under their own terms and privacy practices.
Mrs. Red Art is not responsible for independent third-party content or practices except to the extent that responsibility cannot lawfully be excluded.
15. PRIVACY
Personal data is processed in accordance with the Privacy Policy published on the Site.
Information concerning cookies and similar technologies is also provided in the Privacy Policy and through the applicable privacy preference controls.
16. WEBSITE AVAILABILITY
Mrs. Red Art may maintain, update, modify or temporarily suspend parts of the Site where reasonably necessary.
The uninterrupted or error-free availability of the Site cannot be guaranteed.
Nothing in this section limits any right or remedy that cannot lawfully be excluded.
17. LIABILITY
Nothing in these Terms excludes or restricts liability where exclusion or restriction is prohibited by applicable law.
Nothing in these Terms excludes or limits mandatory consumer rights, statutory remedies or mandatory rules concerning the risk of loss or damage during delivery.
To the extent permitted by applicable law, Mrs. Red Art is not responsible for losses caused solely by unlawful or improper use of the Site by a visitor or by circumstances for which Mrs. Red Art is not legally responsible.
18. GOVERNING LAW AND INTERNATIONAL CONSUMERS
These Terms and the operation of Mrs. Red Art are governed by Hungarian law.
Where mandatory consumer protection provisions of another jurisdiction apply to a consumer, the choice of Hungarian law does not deprive that consumer of protections that cannot lawfully be excluded or restricted.
Nothing in these Terms restricts a consumer’s right to seek remedies before a competent authority, alternative dispute resolution body or court where such rights are provided by applicable law.
19. COMPLAINTS
Questions or complaints relating to a purchase may be submitted to Mrs. Red Art using the contact information below.
Applicable statutory complaint-handling and alternative dispute-resolution rights remain unaffected.
Further legally required information concerning the operator and available consumer dispute-resolution procedures may be provided in the Legal Notice on the Site.
20. LEGAL INFORMATION
The legal identity, postal address and other legally required information relating to the operator of Mrs. Red Art are provided in the Legal Notice available on the Site.
Where additional information is required before a particular purchase is concluded, it will be provided to the prospective purchaser before the purchaser becomes bound by the contract.
21. CHANGES TO THESE TERMS
These Terms may be updated where necessary to reflect changes to the Site, services, business practices or applicable legal requirements.
The revised Terms will be published on the Site.
Changes do not retrospectively alter the terms of a purchase that has already been concluded, except where applicable law requires otherwise.
